- چکیده
- گسترش روزافزون سازمانهای بین المللی در عرصه روابط بین الملل از یک طرف باعث تحکیم روابط و مناسبات بین المللی شده است و از طرف دیگر باعث ایجاد مشکلات و ابهاماتی در چگونگی عملکرد و به تبع آن پذیرش مسئولیت توسط این نهادهای بین المللی گردید است. در این میان ماهیت خاص برخی از سازمانهای بین المللی سبب ابهامات بیشتری در حقوق بین الملل بخصوص در زمینه اجرای قواعد مسئولیت بین المللی شده است. ماهیت نظامی سازمان پیمان آتلانتیک شمالی (ناتو) سبب پررنگ تر شدن نقش اعضاء در عملکرد و جهت دهی به فعالیتهای سازمان شده است. در نتیجه این مسئله می تواند در انتساب اعمال و ایجاد نوعی مسئولیت دوگانه یا مسئولیت همزمان اعضاء و سازمان موثر باشد. در همین راستا در این پایان با بررسی گزارشات کمیسیون حقوق بین الملل در مورد مسئولیت سازمانهای بین المللی، به بررسی مسئولیت سازمان ناتو با توجه به حضور و چگونگی عملکرد اخیرش در افغانستان پرداخته شده است.
- Abstract
- The ever-growing proliferation of international organizations in the arena of international relations has entailed, on the one hand, the enhancement of international understanding and relations and on the other, problems and ambiguities in the practices of international organizations and consequently their accountability. Hence, the special nature of some international organizations has led to more ambiguities in international law in terms of the application of the rules of international responsibility. The military nature of the North Atlantic Treaty Organization (NATO) has underscored the role of its parties regarding the practice and the direction of its operations. Consequently, this can influence the attribution, enforcement and formation of a type of dual or parallel responsibility of the parties and the organization. To this effect, in the present thesis, an attempt is made to study the responsibility of NATO in the light of the reports of the International Law Commission regarding the responsibility of international organizations considering its recent presence and practice in Afghanistan.
