- چکیده
- یکی از رمزهای اساسی ماندگاری دین مبین اسلام، اخلاقی بودن آموزه های آن است. فقه یا حقوق اسلامی که به رفتارهای مکلّفین و مهارتهای زندگی آنان جهت می دهد با اخلاق عملی به طوری در هم آمیخته است که می توان گفت در اسلام، همه احکام شرعی در عرصه های مختلف زندگی با صبغه اخلاقی ظاهر می شوند و این ظهور، نتیجه دخالت و تأثیر اخلاق در فرایند استنباط احکام فقهی توسط فقیهان است. در این پایان نامه برآنیم تا با توجه به اهمیت مباحث خانواده و اثر گذاری زیاد آن بر رفتار فردی، همچنین تحولات اجتماعی، با تحلیل محتوایی گزاره های فقهی مرتبط با حوزه خانواده و بررسی میزان انطباق آن با آموزه های اخلاق اسلامی، میزان همگرایی یا واگرایی احتمالی این دو دانش را در این موضوع خاص مورد بررسی قرار دهیم. مهم ترین رهیافت این پژوهش، موجه سازی اخلاقی گزاره های فقهی است، که از یک سو، بستر مناسبی برای تبلیغ احکام فقهی مرتبط با خانواده را فراهم می کند، از دیگر سو، با تأثیر دادن آموزه های اخلاقی در استنباط احکام شرعی، امکان فهمی غیر اخلاقی از منابع فقهی را به کمترین میزان ممکن خواهد رساند.بررسی های این پژوهش نشان میدهد، آموزه های اخلاقی مورد توجه بیشتر فقهای مسلمان بود، آنان با توجه به رویکرد اخلاقی خداوند متعال در قرآن کریم و امامان معصوم در سنت قولی و عملی خود، در مقام استنباط و بیان و تبلیغ احکیام الهی پیوسته متوجه جنبه اخلاقی احکام بوده اند؛ هرچند تفاوت های عصری و دخالت عنصر زمان و مکان میی توانید سبب برداشت های مختلف از اخلاقی بودن یا اخلاقی نبودن این احکام شود.

This thesis ride to content analysis the related of family jurisprudential propositions and Evaluation of conformity with Islamic moral teachings, to examine the convergence or divergence of these two students in a special issue as for Considering the importance of family issues and Large influence on individual behavior, and social upheaval. The most important approaches to the research of the moral justification of religious propositions, On the one hand, Suitable for ad, related jurisprudence provides of family, On the other hand, by the impact of deduced the moral teachings of religious commandment , the immoral of the theology sources will lead to the lowest possible. Of this study show Further of the Muslim jurists ,was considered the moral teachings They have been consistently attentived to the aspects of moral precepts according to the ethical approach God in the Holy Quran and the practical and promise traditions of the Imams in a position of inferring and expressing and teachings the divine commandments , although the differences in age and interference of time and space elements can lead to different perceptions of moral or immoral precepts.
