- Abstract
- The right to development is a very controvertial issue in the field of international human rights law. There are still coneptual debates around this topic but this right has been accpeted as a basic one especially after the adoptionn of the Declaration on the right to Development (1986). In this study, the main proposition is that the right to development is legally considered in the policy and practice of the World Bank. This study shosw that under article 63 of the UN Charter, the world bank is the meber of the UN system organizations and therefore, it is accountable for the implementation of the right to development in particular and human rights in genral. This accountability stems from the the general priciples of the international law and international custom. In the recent decades, implemnting the right to development has become an oblidation for all the international institutions including the World Bank. This universal bank should aslo observe the elements of the right to development in its projects and failing these obligations, it would be legally responbile, indeed.
