- چکیده
- ورزش از جمله فعالیت های جاری فردی و اجتماعی است که اسلام بر ارزشمندی آن تأکید و مسلمانان را به شرکت در مسابقات ورزشی تشویق کرده است. امروزه ورزش حرفه ای بدون وجود داور امکانپذیر نیست؛ از این رو، داوران از جمله ارکان اصلی هر مسابقه ورزشی به حساب آمده، وظیفه اداره بازی بر عهده آنان است. اداره بازی، مفهومی کلی است که قضاوت یکی از ارکان آن است، به همین جهت، داوری در ورزش تابع احکام و مقررات عمومی قضاوت است؛ داور همچون قاضی، باید با رعایت اصل عدالت و بیطرفی که از جمله قواعد قضاوت است، بازی را اداره کرده، قضاوت نماید. هر چند بر اساس قوانین حاکم بر مسابقات ورزشی، مسئله مصونیت داور، در صورت نداشتن سوءنیت، پذیرفته شده است؛ اما تصمیمات نادرست داوران در مسابقات ورزشی، خسارات قابل توجهی را به وجود می آورد که میبایست جبران شود. از آن جا که به موجب قوانین و مقررات فقهی و حقوقی (اصل عدالت، قاعده لاضرر، قاعده اتلاف و تسبیب)، هیچکس نمی تواند از عواقب سوء تخلفات خود، اعم از عمدی یا غیرعمدی، مصون باشد. از این رو، داوران نیز همانند سایر صاحبان حرف در قبال تصمیمات خود مسئول خواهند بود. بنابراین، داوران نسبت به تصمیمات نادرست خود از جهت کیفری و مدنی مسئول بوده، همچون قضات، در صورت اشتباه، دولت یا سازمانهای مرتبط مسئول جبران خسارت آنها بوده و در صورت تقصیر، جبران خسارت مادی و معنوی وارد بر ورزشکاران و تیم ورزشی، بر عهده خود آنها است.
- Abstract
- Physical education is one of the current social and individual activities that Islam has focused on its value and encouraged Muslims to take part in sport tournaments. Today professional sport is not possible without referee; hence, the referees are among main pillars of every athletic competition, and are responsible to control the game. Controlling the game is a general concept that judgment is one of its pillars. Hence, arbitration in sports is subject to general rules and regulations of judgment; like the judge, the referee must observe the principle of justice and neutrality which is among the judgment rules, control the game. Although based on the regulations prevailing the sport competitions, the issue of referee’s security is accepted in case of no bad intention; but the improper decisions of referees in sport competitions cause remarkable damages which could be compensated for. Whereas due to jurisprudence and legal rules and regulations (the principle of justice, the principle of no damage, the principle of wasting and principle of cause), no one can be safe against the bad consequences of his/her violations whether deliberately or non-deliberately committed. Hence the referee will be responsible against his decisions. Therefore the referee is responsible regarding his improper decisions from criminal and civil point of view. Like judgment, in case of error, the government or concerned authorities shall be responsible to compensate their damages and in case of any fault, compensate for material and moral damages incurred on athletes and sport team.
