- چکیده
- با شناسائی افراد دارای معلولیت به عنوان بزرگ ترین اقلیت جهان در کنار سایر اقلیت ها مسئله رفع هرگونه تبعیض در زندگی آن ها و نیز ایجاد فرصت های برابر برایشان به یکی از دغدغه های نظام های حقوق بشری در سطح داخلی و بین المللی تبدیل شده است. از آنجا که امروزه ناتوانی های ناشی از معلولیت به عنوان معلولِ ناتوانی های شهر و محیط زیست انسان درک می شود، ایجاد شهر و محیطی که دسترسی فرد معلول را به شکل مستقل و بدون خدشه دار کردن کرامت ذاتی اش به محیط ها و خدمات گوناگون به عنوان یک حق بنیادین تامین کند برای تحقق سایر حقوق افراد دارای معلولیت مانند حق آموزش، حق اشتغال، حقوق سیاسی و مشارکت اجتماعی الزامی به نظر می رسد. این پایان نامه تلاش می کند تا ضمن ایجاد یک چارچوب بندی مفهومی و حقوقی از این مسئله، ابعاد و عرصه های مختلف آن و نیز سازوکارهای اجراییش در قوانین بین المللی و داخلی را بررسی کند.
- Abstract
- People with disabilities are the biggest minority in the world So states and international organizations should try to eliminate discrimination in the life of people with disabilities and create equal opportunities for them. One of the most important reasons of their disablements is the Incapacitation and disability of cities and other places people live in. States must build cities in which people with disabilities can independently and equally have access to all physical environments, public services and information as one of their Fundamental Rights. This makes it possible to achieve other Rights of people with disabilities such as Right to education, Right to Work, political Rights and social participation. The right of accessibility protects in article ? of The Convention on the rights of persons with disabilities. This dissertation tries to describe that to enable persons with disabilities to live independently and participate fully in all aspects of life, states shall take appropriate measures to ensure to persons with disabilities access on an equal basis with others, measures which include the identification and elimination of obstacles and barriers to accessibility.
