- چکیده
- فقه اسلامی مبتنی بر تفکری است که نسبت به انسان وجود دارد. انسان در تفکر اسلامی پرتوی از وجود خدا و جانشین خدا بر روی زمین است. فقهای عظام در جای جای فقه اسلامی و نیز در استنباطات خود، در کنار ذکر فتاوی، تصریح به منزلت انسان نموده و آن حکم فقهی را بر منزلت یا کرامت انسان مبتنی کرده اند، لذا انسان شناسی یکی از پایه های فقه اسلامی است. جایگاه انسان در غرب با انسان شناسی اسلامی بسیار متفاوت است. انسان از منظر اسلام، با اتصال به خداوند متعال و پیامبر (صلی الله علیه و آله) دارای اعتبار و ارزش است و این در حالی است که انسان غربی با عناوینی چون اقتصاد و علم و... است که منزلت دارد. فقه اسلامی از آن جهت که انسان را با خدا می سنجد، احکام و تکالیفی را جعل می کند که با وظایف انسان در نظام حقوقی غرب متفاوت است. فقه که مبین حقوق در جامعه ی اسلامی است، بر محور اعتقاد به خدا و تعیین مسیر برای قرب الهی شکل گرفته است، لذا علم فقه دارای برنامه‌ای است که انسان از قبل از تولد تا بعد از وفات به آن نیازمند است و بدون آن کمال بشری به دست نمی‌آید. اما برعکس، انسان در غرب در دو دوره قابل ملاحظه است: قرون وسطی که نظام خدا محوری بر آن حاکم بود و ارزش و اصالت انسان با خدا سنجیده می شد و عصر مدرن که انسان را خود بنیاد و مستقل و بریده از خدا می بیند و بر همین اساس، حقوقی که امروزه در غرب شکل گرفته، اومانیسم و انسان محور است. به طور کلی آنچه در این نوشتار مورد نظر است، بیان امتیاز نظام حقوقی اسلام با رویکرد به معنویات بر حقوق سکولار غربی است.
- Abstract
- The Islamic jurisprudence is based on thinking about man. Man in Islamic thought is supposed to be the light of God and the deputy of God on earth. The jurisprudence and their own inferences has considered the position and dignity of man. They have made that legal injuction based on the position and the generosity of man. Therefore, anthropology is on of the main foundations of the Islamic jurisprudence. There is a big difference between the status of man in the western anthropology and the Islamic one. Acording to islam, man becomes dear and valuable for connecting to almighty god and the prophet ( peace be upon him) but in the west , man becomes dear and respectful for some titles such as economics , science ,etc. As the Islamic jurisprudence measures man with God, it owns some religious obligations and ordinances that are different from the duties of man in the western legal system. the Islamic jurisprudence states the rights in the Islamic society so it is considered to be based on the belief in God and nearness to God . Therefore , the science of the Islamic jurisprudence has a plan that is necessary for man from before his birth until after his death and without this plan humans cannot achieve perfection. In contarary, man in the west can be studied in two different eras: first, the medieval period in which everything was based on a kind of God _ oriented system . Here, the value and the authenticity of man was measured and evaluated according to belief in God. Second, the modern period in which man is supposed to be self _ centered ,Independent and cut off from God.
