- چکیده
- در این پایان نامه ابتدا به مباحث کلی از جمله تبیین اصطلاحات اساسی رساله پرداخته شده است . در نتیجه شش اصطلاح : اولویت ، فحوی ، خطاب ، لحن الخطاب ، مفهوم و قیاس تعریف شده اند . سپس به اقسام اولویت وحجیت این اقسام اختصاص داده شده است و در نهایت چهار نوع از اولویت از یکدیگر تفکیک شدند .
- Abstract
- This thesis is regulated under title of “ the function of the analogy of superior for imamiehjurispudnec& statute law “ . first chapter of this thesis is allocated to general . Second chapter of this thesis is allocated to types of priority and finally four types of priority is separated form each other that consist of : First : putative priority or verbal priority that divides to two part textual priority and conceptional priority . Second : rational priority or absolute priority . surety priority is also joined to this type . Third : social priority . Fourth :suspicional priority or priority analogy that last type is not proof and another types are valid . In third part of thesis , early , the function of superior in private law is proceeded , afterward we refund it`s usage in criminal law. The application of superior in these branches of law is the same as it`s function in other bifurcations of law as international law or public law ,… . so we just study it`s function in two tributaries of statute law. Then by answering to the questions of the analogy of superior in those two branches locates extensive of it`s function in the other trends. It is abvious that all the standards of the valid superior which was declared in the last part , is rehashed in this part too. Fourth part of thesis is allocated to evaluation some of important and operational results of priority inintheorem ofjurisprudence , methodology&jurisprudence . In this chapter jurisprudence & methodology sub is posed and after explaining priority in that it is accuracy and in accuracy is evaluated briefly and schematically .
