- چکیده
- جامعه ی بین المللی از سال 2003 به این سو شاهد یکی از دلخراش ترین فجایع انسانی در دارفور بوده است. در پاسخگویی به نقض شدید حقوق بشر و حقوق بشر دوستانه دارفور، شورای امنیت پس از تعلل فراوان و در اقدامی بی سابقه وضعیت دارفور را در اختیار دادستان دیوان بین المللی کیفری قرار داد. معهذا این ارجاع تنها با اعطای معافیت های فراوان به قدرت های بزرگ شورا ممکن شد و طعم پیروزی را به کام حامیان عدالت کیفری بین المللی تلخ گردانید.
- Abstract
- Since 2003 International Community has witnessed the most heartbreaking human catastrophes in Darfur. In response to serious violations of human rights and humanitarian law in Darfur, the Security Council, after much hesitation and in an unprecedented action, referred the Darfur situation to the Prosecutor of the International Criminal Court. However, the referral was possible only after granting vast exemptions to the great powers of the Security Council and made the advocates of the international criminal justice extremely disappointed. Anyway, the Prosecutor's investigation soon proved that the government of Sudan has not prosecuted the perpetrators of Darfur crimes. The cases covered by the ICC for this purpose, included among which is Al bashir case, were one after the other declared admissible based on the Court's novel interpretation of the principle of complementarity. Furthermore, the Court's approach in proving the occurrence of international crimes, especially with regard to genocide, and in application of the principle of complementarity is arguable. ICC's further challenge, in the next step, is the enforcement of the arrest warrants. In fact, despite Sudan's not being a party to the statute, the issue of personal immunity of the Head of State hinders the state's cooperation with the Court. On the other hand, insistence on seeking justice for victims may result in the increase and continuation of violence in Darfur. Given the above, the only way to save Darfur from atrocities of Khartoum's regime is nothing but the pursuit of international criminal justice.
