- چکیده
- ازآغاز پیدایش بشر جرم و لغزش و به دنبال آن مجازات بوجود آمد و از دیر باز در حقوق اسلامی بصورت یک امر لاینفک به چشم می خورد چرا که اجرای مجازات یکی از راه کارهای جلوگیری از جرم است دراین پژوهش ضمن بررسی عنصر زمان و مکان و تاثیر این دو برمجازات ، به نقش و جایگاه مجازات پرداخته می شود و جایگاه آن از نظر کمیّت وکیفیّت مورد بررسی قرار می گیرد و به بررسی تاثیر پذیری مجازات در شرایط مختلف اشاره می شود و آنچه مورد نظر است آراء فقهای مذاهب اسلامی بر تاثیر زمان و مکان در مجازات اسلامی است در این تحقیق سعی شده است با استفاده از روایات و متون فقهی تاثیر گذاری زمان و مکان برمیزان و نحوه اجرای مجازات مورد نظر قرار بگیرد اجرای مجازات اسلامی در شرایط مختلف زمانی و مکانی ، از مصالح بنیادین جامعه اسلامی است و مشخص می گردد زمان ومکان بر حقوق کیفری اسلام تأثیر دارد بررسی جرم و مجازات و حدود اسلامی ، نحوه اجرای مجازات ،اثر زمان در تأخیر و تشدید مجازات ،اثر زمان در عدم اجرای مجازات، دیدگاه مذاهب اسلامی در مورد تاثیر زمان در نحوه اجراء و میزان مجازات ، ازمباحث عمده این تحقیق است همچنین سعی شده تا نقش مکان های مقدّس و اثر آنها را در نحوه اجراء و میزان مجازات مورد ارزیابی قرارداده و در مرحله بعد به نظرات فقهای شیعه و فقهای اهل سنت در مورد تغلیظ (شدت و سخت گیری ) در مجازات پرداخته شود و در فصل آخر نیز جمع بندی و نتیجه گیری مباحث ارائه می گردد
- Abstract
- After the appearance of crime and lapse, Punishment came to existence as well, and it have been seen, since long time ago, across the Islamic law as a essential component, because executing the punishments is one of ways preventing crime. In this research, beside studying the temporal and spatial elements and their effects on punishment, the role and position of Punishment will be addressed, and its position and the impressibility of punishment through different conditions, and what is subject of interest is the ideas of Islamic jurisconsults regarding the effect of temporal and spatial aspects will be analyzed quantitively and qualitatively. In this research, it has been tried to focus on the effects of temporal and spatial aspects on punishment, using Islamic narratives and jurisprudencial texts. Execution of Islamic punishments, in different temporal and spatial conditions, is one of the substantial prospects of the Islamic society, and it will appear that time and space affect the Islamic penal law(Criminal law). Investigating the crime, punishment and Islamic limits, punishment execution quality, the time effect on punishment postpone and intensification, time effect on non-execution of punishment, the Islamic religions’ point of view regarding the effect of time effect with respect to quality and extent of punishment, are the main issues of this research. Also, we tried to evaluate the role of holy places and their effect on execution quality and extent, and, then, address the opinions of Shia and Sunnite jurisconsults regarding punishment extremitization (intensity and stringency), and in the last chapter, summary and conclusion, the discussions will be provided.
